Acceptable Use Policy

This Acceptable Use Policy (“AUP”) sets forth the rules and guidelines for the use of the website escapement.io (the “Site”) and any services provided by Escapement LLC (“Escapement,” “we,” “us,” or “our”). This AUP is incorporated by reference into our Terms of Service. By using the Site or our services, you agree to comply with this AUP.

1. General Conduct

You agree to use the Site and our services in a responsible, ethical, and lawful manner. You are responsible for ensuring that your use of the Site complies with all applicable federal, state, and local laws, regulations, and ordinances, including those of the State of Georgia and the United States.

2. Prohibited Uses

You may not use the Site or our services to engage in, facilitate, or promote any illegal activity, including fraud, money laundering, or the violation of any applicable law or regulation; transmit, distribute, or store any material that is infringing, obscene, defamatory, threatening, harassing, abusive, or otherwise objectionable; attempt to gain unauthorized access to the Site, other users’ accounts, computer systems, or networks connected to the Site through hacking, password mining, or any other means; introduce malicious software, including viruses, worms, trojan horses, ransomware, spyware, or any other code designed to disrupt, damage, or limit the functionality of any software or hardware; use any automated means (including bots, crawlers, scrapers, or spiders) to access, monitor, or copy any content from the Site without our prior written consent; interfere with or disrupt the integrity or performance of the Site or its underlying infrastructure; impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity; collect, harvest, or assemble personal information about other users without their express consent; or send unsolicited commercial communications (spam) using information obtained from the Site.

3. Client Responsibilities

If you are a client of Escapement LLC receiving web development, hosting, or related services, you additionally agree that you are solely responsible for all content you provide to us for inclusion on your website or platform, including text, images, logos, and data; you will not request or require us to develop, host, or deploy content that is unlawful, infringing, defamatory, or otherwise in violation of any applicable law; you will maintain accurate and current contact and billing information; you will not use hosting services provided by Escapement LLC to host content or applications that engage in any activity prohibited by this AUP; and you are responsible for obtaining all necessary rights, licenses, and permissions for any content you provide.

4. Content Restrictions

You may not use our services to host, develop, or distribute content that promotes or facilitates illegal gambling, unlicensed pharmaceutical sales, or controlled substances; contains child sexual abuse material or exploits minors in any way; promotes terrorism, violence, or hate speech against any individual or group; infringes on the intellectual property rights of any third party; constitutes phishing, pharming, or other deceptive practices designed to obtain sensitive information; or violates the privacy rights of any individual.

5. Resource Usage

If you are a client using hosting services provided by Escapement LLC, you agree not to use server resources in a manner that degrades service for other clients or systems, including but not limited to cryptocurrency mining, excessive automated processes, or deliberate denial-of-service activities. Resource usage limits, if applicable, are defined in your Client Services agreement.

6. Security

You are responsible for maintaining the security of any credentials (usernames, passwords, API keys, or authentication tokens) provided to you in connection with our services. You must promptly notify us at jonathan@escapement.io if you become aware of any unauthorized use of your account or any other breach of security. You may not use our services to conduct security testing, penetration testing, or vulnerability scanning against any system (including our own) without prior written authorization.

7. Enforcement and Remedies

Escapement LLC reserves the right to investigate any suspected violation of this AUP and to take any action we deem appropriate, including issuing a warning, suspending or terminating your access to the Site or services, removing content that violates this AUP, reporting illegal activity to the appropriate law enforcement authorities, and pursuing legal action to recover damages caused by violations of this AUP. We may exercise these remedies without prior notice if, in our sole judgment, the violation poses an immediate risk to the security, integrity, or availability of our systems or the systems of others.

8. Reporting Violations

If you become aware of any violation of this AUP, please report it to us at jonathan@escapement.io. We will investigate all credible reports and take appropriate action.

9. Changes to This Policy

We reserve the right to modify this AUP at any time. Changes will be effective upon posting to the Site with an updated “Last Updated” date. Your continued use of the Site or services after any changes constitutes your acceptance of the revised AUP.
